NOTICE OF JUDICIAL SALE

Pursuant to an Amended Order of Sale entered in United States of America vs. Susan Heller, Case No. 2:22-cv-516-SPC-KCD, United States District Court, Middle District of Florida, Fort Myers Division, the United States will offer for sale at public auction, to the highest bidder, according to law and pursuant to the terms and conditions set herein, the property described below:

Sale Location: The Sale of the Property shall be by public auction at 1810 Hale Ave., Harlingen, Texas 78550 (Rear parking lot) or under mail-in bids.

Title Offered: The property shall be offered for sale at public auction, free and clear of all liens and interests of the parties to this action.

Description of Property: 1,578 sq. ft., Single Family Residence, built 1988/1990 situated on 0.14 acres more commonly known as 12601 Hunters Ridge Dr., Bonita Springs, FL. 34135 Parcel No. 06-48-26-B3-0010C.0020.

Property may be inspected at: Drive by any time. Open House on August 13, 2026, from 9:00 A.M- 11:00 A.M.

Minimum Bid: $225,000

TERMS AND CONDITIONS OF SALE:
No bid (except for bids made by the United States) shall be accepted by the IRS, unless the same is accompanied by a certified check or cashier’s check, in the minimum amount of $45,000 (20% of minimum bid) made payable to the United States District Court Middle District of Florida. No bids will be received from any person who has not presented proof that, if they are the successful bidder, they can make the deposit required by the Order. If the sale is conducted via mail-in bid, all bids are to be received by PALS no later than 11:00 A.M. on the day of the Sale.

The successful bidder shall tender the balance of the purchase price, in certified funds payable to the United States District Court Middle District of Florida, at the office of the IRS on or before 2:30 PM, within forty-five (45) days following the date of sale (October 12, 2026). If the sale is conducted via mail-in bid, the deposit is to be provided with the bid and will be returned if the bid is not accepted.

In the event the successful bidder defaults on any of the terms contained in the Order, the sale shall be treated as null and void, and the deposit shall be forfeited as damages and retained as part of the proceeds of sale, and the real property shall again be offered for sale under the terms and conditions of the Order of Sale, or, in the alternative, the real property shall be sold to the second highest bidder, at the sole discretion of the United States.

Each mail-in bid will be deemed to make a first bid of the minimum bid specified by the Property Appraisal Liquidation Specialist (“PALS”). Each mail-in bid must also specify the maximum bid the bidder wishes to make. Failure to specify a maximum bid will result in the bid being invalid, and the PALS shall return the bid and deposit to the bidder.
If the PALS receives at least two valid mail-in bids, the winning bidder shall be the one with the highest maximum bid, and the sales price will be the lesser of (1) of the second-highest maximum bid plus $1,000, or (2) the highest maximum bid.
If two or more different mail-in bidders specify the same maximum bid and that maximum bid is the highest maximum bid, the PALS may, without further authorization from the Court, solicit further mail-in bids from all such bidders until a single bidder has the highest maximum bid.
The United States may bid as a creditor against its judgments without tender of cash.

The sale of the property shall be subject to confirmation by the Court. Upon confirmation of the sale, the IRS shall execute and deliver to the purchaser a deed conveying the real property to the purchaser. Upon confirmation of the sale, all interests in, liens against, or claims to the real property that are or may be asserted by any of the parties to this action are discharged and extinguished.

The United States reserves the right to reject any and all bids and to withdraw the property from sale. The sale shall be subject to building lines if established, all laws, ordinances, and government regulation (including building and zoning ordinances), affecting the premises, and easements and restrictions of record, if any. There is no right to redeem the property after the judicial sale. The property is offered for sale "where is" and "as is" and without recourse against the United States. The United States makes no guaranty or warranty of the condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.

The PALS must receive the written withdrawal prior to the subject sale. On a deferred payment sale, failure by the Bidder to pay any remaining balance due on the bid in accordance with the Notice of Public Auction Sale may result in the Bidder forfeiting the initial bid deposit.
