All that certain apartment known as Villa Number 4259 in Mariners Watch Villas Horizontal Property Regime as shown on the plans and specifications attached to that certain Masters Deed executed by Kiawah Island Company Limited dated January 31, 1981, and recorded February 4, 1981, In Book P-124, Page 95 in the RMC Office for Charleston County, South Carolina.
By the acceptance and recordation of the within deed, the Grantees hereby expressly assume and agree to comply with all terms, conditions and covenants contained in said Master Deed and the By-Laws attached to said Master Deed.
This conveyance is made subject to the following:
a) All covenants, obligations. restrictions and limitations contained in the Declaration of Rights, Restrictions, Affirmative Obligations and Conditions, recorded in Book M-114, Page 406 in the RMC Office for Charleston County, as amended.
b) All covenants, obligations, restrictions and limitations applicable to Class "B" Residential Areas of Kiawah Island, all as contained in the Declaration of the Kiawah Island Company, Inc. recorded in Book T108, at Page 340, in the RMC Office for Charleston County.
c) All covenants, obligations, restrictions and limitations as contained ln the Declaration of Covenants and Restrictions of the Kiawah Island Community Association, Inc., declared by the Kiawah Island Company Limited and recorded in Book M-114, Page 407 in the RMC Office for Charleston County, as amended.
d) Zoning ordinance of the Town of Kiawah Island.
e) Assessments as may become due and payable.
f) Taxes for 1999, not yet due and payable, and all subsequent years.
The sale is ordered in accordance with 28 U.S.C. Section 2001 and is made without the right of redemption.
The United States may bid as a creditor against its judgments without tender of cash.
The sale of the real property shall be subject to confirmation by the Court. Upon confirmation of the sale and receipt of the entire purchase price, the Court shall issue, and the IRS shall deliver to the purchaser, a deed conveying the real property to the purchaser. Upon confirmation of the sale, all interests in, liens against, or claims to, the real property that are or may be asserted by any of the parties to this action are discharged and extinguished.
The United States reserves the right to reject any and all bids and to withdraw the property from sale.
